APSPitchPro Terms of Service

These Terms of Service ("Terms") govern your use of the APSPitchPro website, application, and related services (the "Services") operated by APSPitchPro ("APSPitchPro", "we", "us", or "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.

1. About APSPitchPro

APSPitchPro provides an online platform that helps users prepare APS job application materials and practise interviews, including AI-generated pitch drafting, editing tools, interview practice features, and related content.

APSPitchPro is a software tool only.

APSPitchPro is an independent service and is not affiliated with, endorsed by, or operated by the Australian Public Service, the Australian Government, or any government agency.

We do not provide legal advice, recruitment advice, employment advice, or guaranteed career outcomes.

We do not guarantee that using APSPitchPro will result in interviews, shortlisted applications, job offers, or improved performance.

2. Eligibility

You must be at least 18 years old, or the age of majority in your country, to use the Services.

By using APSPitchPro, you confirm that you have the legal capacity to enter into these Terms.

3. Accounts

You may need to create an account to use some features.

You agree to:

  • Provide accurate information
  • Keep your login details secure
  • Be responsible for all activity on your account

We may suspend or terminate accounts that violate these Terms.

4. User Content

You may upload, enter, or create content through the Services, including resumes, job descriptions, STAR examples, interview responses, transcripts, notes, and other materials.

You are responsible for any content you upload, enter, or share. You must not upload, submit, or share content that is:

  • Unlawful
  • Abusive, threatening, or harmful
  • Misleading or deceptive
  • Defamatory
  • Infringing another person's intellectual property or privacy rights
  • Malicious code, spam, or harmful material

We may remove content or restrict access if we believe it violates these Terms.

5. AI-Generated Content

APSPitchPro may generate pitches, interview feedback, summaries, model answers, or other content using automated systems or artificial intelligence.

This content is provided for informational and drafting assistance only.

We do not guarantee that AI-generated content is accurate, complete, reliable, suitable, or free from errors.

You are responsible for reviewing, editing, and verifying all AI-generated content before relying on it or using it in any application, interview, or other context.

6. Interview Practice Features

APSPitchPro may offer interview practice features, including voice-based or transcript-based tools.

These features are provided for practice and self-preparation only.

They are not professional coaching, assessment, or recruitment services, and they do not guarantee any particular interview outcome.

7. Paid Features, Credits, and Billing

Some features of the Services may require payment, including credits, paid plans, or other paid features.

If you purchase paid features:

  • You agree to pay the price displayed at the time of purchase
  • You authorise our payment provider to process your payment
  • You are responsible for any applicable taxes, fees, or charges associated with your purchase

Unless we state otherwise at the time of purchase, credits:

  • are for use only within APSPitchPro
  • are not redeemable for cash
  • are not transferable to another user

We may change pricing or introduce new fees in the future. If we do, we will provide reasonable notice where required.

8. Third-Party Services

APSPitchPro may rely on or link to third-party services, including authentication providers, cloud hosting, storage providers, analytics tools, AI providers, voice interview providers, and payment processors.

We do not control these services and are not responsible for them. Your use of third-party services may be subject to their own terms and policies.

9. Acceptable Use

You must not use the Services to:

  • Break any law
  • Harass, abuse, or harm others
  • Upload malicious code or harmful material
  • Copy, scrape, or exploit the platform without permission
  • Interfere with the security or operation of the Services
  • Misuse AI features
  • Attempt to access accounts, data, or systems without permission
  • Impersonate another person or misrepresent your identity

We may suspend or terminate access for misuse.

10. Intellectual Property

All software, design, branding, content, and functionality in the Services are owned by APSPitchPro or its licensors.

You may not copy, modify, distribute, reverse engineer, resell, or exploit the Services except as permitted by law or with our written permission.

You retain ownership of the content you upload or submit. However, you grant APSPitchPro a non-exclusive, worldwide, royalty-free licence to host, store, process, reproduce, and use that content as needed to provide, maintain, improve, and secure the Services.

11. No Warranties

The Services are provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we make no warranties or representations about:

  • Accuracy
  • Reliability
  • Availability
  • Suitability
  • Performance
  • Fitness for a particular purpose

We do not guarantee the Services will be uninterrupted, error-free, or free from loss, corruption, delay, or security issues.

12. Limitation of Liability

To the maximum extent permitted by law, APSPitchPro is not liable for:

  • Inaccurate or incomplete AI-generated content
  • Application, interview, or employment outcomes
  • Loss of data
  • Service interruptions or downtime
  • Third-party services
  • Indirect, incidental, special, or consequential loss

Our total liability to you in connection with the Services is limited to the amount you paid to use the Services in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law or other applicable laws.

13. Indemnity

You agree to indemnify and hold harmless APSPitchPro and its officers, employees, contractors, and affiliates from any claim, loss, liability, damage, or expense arising from:

  • Your unlawful or unauthorised use of the Services
  • Your breach of these Terms
  • Content you upload, submit, or share
  • Your violation of any law or third-party right

14. Service Interruptions and Changes

We may modify, suspend, or discontinue the Services, or any part of them, at any time.

We are not liable for any loss caused by downtime, errors, maintenance, or changes to the Services, except as required by law.

15. Privacy

Your use of the Services is also governed by our Privacy Policy, available on our website. By choosing to use our services, you agree to the collection, use and disclosure of information as described in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify users through the Services, on our website, or by email.

Your continued use of APSPitchPro after changes are published means you accept the updated Terms.

17. Termination

We may suspend or terminate your access if you breach these Terms or if we reasonably believe your use of the Services creates risk for APSPitchPro, other users, or third parties.

You may stop using the Services at any time.

You may also request deletion of your account by contacting us at support@apspitchpro.com.

18. Governing Law

These Terms are governed by the laws of Australia.

Where permitted by law, you and APSPitchPro submit to the courts with jurisdiction in Australia for any dispute arising out of or connected with these Terms or the Services.
